1. Agreement to Terms
These Terms of Service govern access to and use of Qivoranet websites, applications, and hosting services. By creating an account or using our services, you agree to these Terms.
If you are using the services on behalf of an organization, you represent that you have authority to bind that organization to this agreement.
2. Account Eligibility and Security
- You must be legally able to enter a binding contract in your jurisdiction.
- You must provide accurate account and billing information and keep it updated.
- You are responsible for all activity under your account credentials.
- You must promptly notify us of unauthorized access or suspected compromise.
3. Acceptable Use
You may not use the services to violate law, infringe rights, or harm systems, users, or networks.
- Illegal content, fraud, phishing, malware distribution, or abuse
- DDoS, unauthorized scanning, intrusion attempts, or exploitation activity
- Spam, deceptive communications, or abusive automated traffic
- Resale or sub-allocation without an applicable written agreement
We may investigate abuse reports and suspend affected services where reasonably necessary to protect the platform and other customers.
4. Service Scope and Availability
Services are delivered on an as-provisioned basis using Qivoranet infrastructure, including operations from Eygelshoven, Netherlands.
We target high availability and may perform scheduled or emergency maintenance. Availability commitments and remedies, if any, are defined by the applicable service plan or SLA.
Our Netherlands operations are technical and infrastructure-focused only. Corporate registration, contracting, and legal governance are under UK law.
5. Fees, Billing, and Taxes
- Services are billed in advance according to your selected billing cycle.
- Recurring services auto-renew unless canceled before renewal.
- You authorize Qivoranet to charge valid payment methods on file.
- Published fees exclude taxes unless stated otherwise.
Late or failed payments may result in suspension, service restriction, or termination.
6. Refunds and Cancellations
Unless a plan explicitly includes a refund guarantee, fees are non-refundable. Domain registrations, licenses, and one-time setup charges are non-refundable.
You may cancel from the account area at any time. Unless otherwise stated, cancellation applies to future renewals and does not retroactively refund completed billing periods.
7. Customer Content and Backups
You retain ownership of your content and data. You are responsible for ensuring your content is lawful and for maintaining independent backups.
Any backup or recovery features we provide are supplementary and are not a substitute for your own business-continuity controls.
8. Suspension and Termination
We may suspend or terminate services for material breach, abusive activity, legal requirements, or non-payment, with notice where commercially reasonable.
Following termination, data may be deleted under our retention schedule. It is your responsibility to export data before cancellation or account closure.
9. Disclaimers and Limitation of Liability
To the maximum extent permitted by law, services are provided "as is" and "as available". Qivoranet disclaims implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, Qivoranet is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, or data. Aggregate liability is limited to fees paid for the affected service during the 12 months preceding the event giving rise to the claim.
10. Changes to Services and Terms
We may update services and these Terms to reflect legal, technical, or business changes. Material changes will be posted on this page and may be communicated through account or email notices. Continued use after the effective date constitutes acceptance.
11. Governing Law and Venue
These Terms are governed by the laws of the United Kingdom, without regard to conflict-of-law principles, unless mandatory law in your jurisdiction requires otherwise.
