1. Introduction

Welcome to Qivoranet. These Terms of Service ("Terms") govern your access to and use of Qivoranet's hosting services, websites, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use our Services. These Terms constitute a legally binding agreement between you and Qivoranet.

2. Eligibility and Accounts

To use our Services, you must:

  • Be at least 18 years old or have the legal capacity to enter into contracts in your jurisdiction
  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities that occur under your account

You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Acceptable Use Policy

You agree not to use our Services to:

  • Violate any applicable laws, regulations, or third-party rights
  • Transmit, distribute, or store any material that is illegal, harmful, threatening, abusive, or defamatory
  • Engage in any form of spam, phishing, or unsolicited communications
  • Launch or participate in denial-of-service (DDoS) attacks or other network attacks
  • Host, distribute, or link to malware, viruses, or other malicious code
  • Infringe upon intellectual property rights, including copyrights, trademarks, or patents
  • Engage in cryptocurrency mining without explicit written permission
  • Operate high-risk services such as Tor exit nodes, public proxies, or VPN services without authorization
  • Resell or redistribute our Services without a valid reseller agreement
  • Use excessive resources that may impact other customers' services

We reserve the right to suspend or terminate your account immediately if we determine, in our sole discretion, that you have violated this Acceptable Use Policy.

4. Payment, Billing, and Refunds

4.1 Payment Terms

All Services are billed in advance on a monthly or annual basis, as selected during purchase. Payment is due immediately upon invoice generation. We accept major credit cards, PayPal, and bank transfers for qualified customers.

4.2 Automatic Renewal

Services automatically renew at the end of each billing period unless you cancel before the renewal date. You authorize us to charge your payment method automatically for renewal fees.

4.3 Refund Policy

We offer a 30-day money-back guarantee for new customers on their first service purchase. Refunds are processed within 5-10 business days to the original payment method. The following are not eligible for refunds:

  • Services canceled after the initial 30-day period
  • Add-on services, domain registrations, or one-time fees
  • Accounts terminated for violation of these Terms
  • Refunds requested more than 30 days after the initial purchase

4.4 Late Payments

If payment is not received by the due date, we may suspend your Services. Accounts suspended for non-payment may be subject to a reactivation fee. Services may be permanently terminated if payment is not received within 30 days of the due date.

5. Service Uptime and SLA

We strive to maintain 99.9% uptime for our Services. Our Service Level Agreement (SLA) guarantees network and power availability, but does not cover:

  • Scheduled maintenance windows (with advance notice)
  • Issues caused by customer applications or configurations
  • DDoS attacks or other security incidents
  • Force majeure events
  • Third-party service provider outages

If we fail to meet our uptime guarantee, you may be eligible for service credits as outlined in our SLA documentation. Service credits are the sole and exclusive remedy for SLA violations.

6. Suspension and Termination

We reserve the right to suspend or terminate your Services immediately, without prior notice, if you:

  • Violate these Terms or our Acceptable Use Policy
  • Fail to pay fees when due
  • Engage in fraudulent or illegal activities
  • Pose a security risk to our infrastructure or other customers

You may cancel your Services at any time through your account dashboard or by contacting support. Cancellation takes effect at the end of your current billing period. No refunds will be provided for the remaining period unless covered by our refund policy.

Upon termination, all data associated with your account may be permanently deleted after a 30-day grace period. You are responsible for backing up your data before cancellation.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QIVORANET SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES.

Our total liability for any claims arising from or related to these Terms or our Services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

We are not responsible for any loss or damage resulting from your failure to comply with security best practices, including but not limited to weak passwords, unpatched software, or misconfigured services.

8. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email to the address associated with your account at least 30 days before they take effect.

Your continued use of our Services after the effective date of any changes constitutes your acceptance of the modified Terms. If you do not agree to the changes, you must cancel your Services before the changes take effect.
